Here we call the Action #2 from you: Mobilize Five Americans. Ask them to call/

An American's voice is louder in the Capitol Hill than that of a non-resident
or a permanent resident, for he has the voting right.

So, mobilize your supervisor, mobilize your teaching professors, mobilize you

Sample letter for Americans

Dear Representative XXX:

I understand that a bill on immigration is under consideration and that the
bill contains restrictions on academic visitors obtaining green cards and
becoming naturalized citizens. This would be a grave error.

It is reasonable, perhaps, to reduce the influx of unskilled immigrants who
will become dependent on support services. However, to exclude immigrants with
extraordinary skills seems foolhardy. The wealth of the United States is a
result of the drive produced by energetic immigrants.

For whatever reasons, the United States has failed miserably in training
students with quantitative skills in the sciences, engineering and mathematics.
It is extremely rare to find a qualified US applicant for a position requiring
these abilities. If we exclude smart, and technically qualified foreigners, not
only will US industry be deprived of an essential asset, but we will lose the
role models for technical success; models that hopefully will help to
regenerate the American values that used to lead our youngsters into
technically demanding positions.

I urge you to vote against the provision that excludes highly qualified
foreigners from obtaining resident visas.

Dear Miao Ye,

Ever since the Golden Venture ordeal and Prop.187 in California, I have been
concerned about the overwhelming anti-immigration mentality that is sweeping
the country. Therefore, HR1915 came as no suprise to me. As someone who writes
about China, has great regard and appreciation for both Chinese people and
Chinese culture, I have been extremely concerned about the effects this bill
will have on the immigrant Chinese community in the US, and specifically my
Chinese friends. I have already expressed my objections to HR1915 to my
Senators and Congressmen.

In addition, I would like to make a suggestion to your committee. Although I
agree with your concerns about stirring up a backlash against any public
campaign, I feel it might be helpful for the Chinese immigrant community to
inform the general public of their many accomplishments and the benefits they
offer to American society. Perhaps making known statistics regarding the number
of Chinese students and scholars currently active in scientific, technological,
and social programs that assist the advancement of the US might have an impact
on American voters and on the members of Congress who are considering this
bill.

Editors Note: The following is abridged from a doctoral research paper,
part of Mr. Houliang LI's Disertation. Of five chapters in
this paper, we will carry the Chapter I and Chapter IV in
our New Releases. We choose this article not only because
Mr. Houliang LI has taken great effort to recollect this rare
event in a systematic manner, but also has provided an indepth
analysis on how this "impossible" could be realized, by a group
of Chinese students and scholars, who faced "incredible odds
against them". This is exactly the situation our community
is now facing, in front of the anti-immigration tidal wave.
Again, with courage, wisdom and solidarity, we shall overcome.

CBS Incident
A Case Study of the Awakening of Publics
and its Implications for Situational Theory

CHAPTER I. INTRODUCTION

A. Background

On October 21, 1994, CBS broadcasted a "clarification" in its evening
news program coanchored by Dan Rather and Connie Chung, a rare occurrence
in its 50-year television history. The announcement read,

Here is a clarification for a story we did last May on the Evening
News. Our story concerned documented evidence of efforts by the Chinese
government to recruit as spies some Chinese people who come to the United
States. It was not our intention to leave the impression that there were
more than a small number of such individuals among the many thousands of
legitimate Chinese students, visitors, and immigrants who come to the
United States every year. If we left an incorrect impression, we regret it.

While many of the viewers might feel puzzled by the clarification, a
particular audience, i.e., Chinese students and scholars, Chinese Americans,
and permanent residents of Chinese ancestry, had been anxiously waiting for
it. In fact, this particular audience had been notified of the announcement
beforehand and had been encouraged to watch the program on this particular
evening. They expected, in excitement, to hear an apology from CBS about a
May report on Chinese spies.

All this puzzlement and excitement originated from Connie Chung's story,
"Eye on America," on the Evening News of May 19. In her report, Connie Chung
claimed that China was running "the biggest spy network in America" and that
"you could find them [Chinese spies] in the house next door." 2 In the
opening statement, especially, Connie said,

Every day, planeloads of Chinese citizens arrive legally in the United
states, ordinary people. But to the Chinese government, some of them may
be future spies, who a few years down the road, will be activated to steal
America's military and technological secrets, whether they want to or not.

Connie Chung went on to cite a certain Mr. Nicholas Eftimiades, author of
the newly published book Chinese Intelligence Operations, which later turned
out to be the primary basis for the story, then showed the alleged process
of spy recruitment by the Chinese Ministry of State Security and how it
threatened a Chinese agent in the United States, and finally quoted a
"security expert" to the effect that Chinese-looking people, be they
American citizens, permanent residents, or Chinese students and scholars,
had to be guarded against carefully because they all could be targeted by
the Chinese spy organization for recruitment, thus posing a real threat to
the American military and technological security.

B. The Publics

Immediately following the spies report came an unprecedented wave of
protests by all kinds of people of Chinese origin in the United States.
Thousands of individuals sent letters, made phone calls, or emailed to CBS
News to voice their indignation upon being indiscriminately accused of
spying for China or unfairly portrayed as potential Chinese spies simply
because of their Chinese descent. They condemned the CBS report as
"unprofessional, irresponsible, subjective, bigoted, and tabloid style,"
and many demanded an apology from CBS as well.

Taking the lead in the whole process was the CBS Incident Committee
(CBS-IC), an organization specially established for protesting CBS and
seeking apology and justice, which was composed primarily of current
Chinese students and scholars in the United States. Also active were the
Independent Federation of Chinese Students and Scholars (IFCSS), a
prodemocracy Chinese student / scholar association founded here after the
1989 Tiananmen Square demonstrations and bloodshed in China; the
Organization of Chinese Americans (OCA), the largest nationwide
organization for advocating the civil rights and other equal rights of
Chinese Americans (American citizens and legal residents of Chinese origin);
and the Committee of 100 (C/100), an organization comprising prominent and
successful Chinese Americans.

From its start on May 19 with the CBS spies report to its close on October
21 with the CBS clarification, the whole incident was an excellent display
of how a latent public was awakened by the consequences of an organization
and in turn sought to influence the organization in its favor. Therefore,
the purpose of the study is to determine how well the situational theory of
publics as formulated by James E. Grunig can be used to explain the unusual
incident and to seek to advance the theory one step in terms of proposing
the factors that determine whether a public will become aware or active
when faced with conditions of high problem recognition, high constraint
recognition and high level of involvement.

C. Major Events

To facilitate the narration of the incident and analyses of its
theoretical implications, all the major documented events or actions that
had happened in connection with the incident are listed below in
chronological order. The entire span of the incident fell within 1994, so
the year will be omitted in the list. It should be pointed out that some
of the important events took the form of telephone and interpersonal
conversations. The fact that they are not in the list should in no way
deemphasize their significance.

May 19 CBS

Coanchor Connie Chung broadcasted the Chinese spies report on Evening News.

May 23 IFCSS

VP (Vice President) Heping Shi of the Independent Federation of Chinese
Studnets and Scholars sent a letter of protest to CBS News President
Mr. Eric Ober asking for actions to mend damages and for balanced and
realistic reporting of Chinese nationals.

May 28 CBS-IC

CBS Incident Committee was initiated by Lin Huang, Ning Luo and Chengyan
Liu, three Chinese students, and joined by a dozen other students and
scholars. At its peak, the CBS-IC consisted of some 80 members. Mr. Huang
was coordinator (de facto chairman), and Mr. Luo and Mr. Liu were to leave
the committee later for presidency and vice presidency of IFCSS
respectively.

June 1 CBS

VP of Hard News and Special Events Mr. Lane Venardos replied to Mr. Shi of
IFCSS refusing any blame on the story or CBS and declaring "We stand by it."

June 11 UCONY

The Union of Chinese Organizations in New York (UCONY), which represented
33 Chinese local organizations in New York metro area, held a press
conference in Chinatown protesting Connie Chung and her report. UCONY also
demanded a public apology from CBS and called on Chinese Americans and
Chinese nationals to write to CBS in protest.

June 17 OCA

The Organization of Chinese Americans National President Ms. Ginny Gong
sent a letter to the Director of Defense Intellegence Agency (where
Mr. Nicholas Eftimiades, author of Chinese Intelligence Operations,
worked) Lt. General James R. Clapper, Jr., asking for confirmation of
Mr. Eftimiades' and his book's authority and accuracy as well as the
officiality of the publication.

June 17 OCA

OCA National President Ginny Gong sent a letter to Commissioner Charles
Wang of U.S. Commission on Civil Rights (USCCR) voicing concern over the
potential consequences of the CBS report on Chinese and other Asian
Americans in terms of employment discrimination and anti-immigrant
sentiment, and requesting USCCR looking into the validity and depth of the
CBS report.

July 15 CBS (Connie Chung)

Connie Chung gave an interview to China Press, a daily newspaper published
in Chinese in the United States. She defended her report in terms of
objectivity and factual accuracy, but expressed regret over unintended
harm to "viewers of Chinese origin"6 caused by the report.

July 19 Xinhua

Xinhua News Agency, the official Chinese news agency, issued an editorial
by its Washington branch chief Qian Ying denouncing the CBS spies report.

July 19 C/100

The Committee of 100 Director Mr. Weiming Liu sent a letter to Senator
Paul Wellstone from Minnesota welcoming his offer to personally write to
the CBS network about the report. They have previously met and discussed
the matter.

July 20 OCA

OCA National President Ginny Gong wrote to CBS News President Eric Ober
criticizing sensationalism in the spies report and requesting a formal
apology.

July 27 CBS

VP of Hard News and Special Events Lane Venardos replied to Ms. Ginny
Gong refusing apology because " we have done nothing to require it."7 He
also claimed that the story would have no effect exacerbating
discrimination against Asian Americans.

July 28 CBS-IC

CBS Incident Committee Coordinator Lin Huang wrote to Director of OCA
Ms. Daphne Kwok requesting support and cooperation in fighting for " fair
media."8

July 28 CBS-IC

CBS Incident Committee Coordinator Lin Huang sent a letter to Mr. Lane
Venardos, VP of Hard News and Special Events of CBS News, regarding his
response to VP of IFCSS Heping Shi on June 1. Mr. Huang gave a detailed
analysis of the spies report and demonstrated that at least SEVEN major
mistakes or misrepresentations were committed, including basic facts and
general implications. He demanded a formal public apology and an " equal
air-time "9 of objective discussion of the issue.

July 28 CBS-IC

CBS Incident Committee sent the same letter for Mr. Lane Venardos to CBS.,
Inc. President Howard Stringer, VP Eric Ober (who was also president of CBS
News), two producers of the spies report, Connie Chung and Dan Rather, and
a dozen major national media, all the related government agencies including
FCC and USCCR, civil rights agencies, Congress and its relevant committees.
A signature sheet with more than 6,000 people, together with the transcript
of the May 19 report and the correspondences between IFCSS and CBS News was
also enclosed in every letter dispatched.

August 16 DIA

On behalf of Defense Intelligence Agency (DIA) director Lt. General
Clapper, Donald R. Lenker, chief of Public Liaison Staff of DIA, wrote to
OCA President Ginny Gong stating the private and unofficial nature of the
book Chinese Intelligence Operations and the author's writing activity.
He quite agreed that " the premise that all Chinese people in the United
States ... are possible spies of the PRC is totally unwarranted and
highly inflammatory."10 He further mentioned that the author Mr. Eftimiades
had given a series of media interviews to publicize his book at the behest
of his publisher.

August 25 OCA

The OCA National President Ginny Gong wrote to VP of Hard News and
Special Events of CBS News Lane Venardos regarding his reply to her letter
of July 20. Ms. Gong suggested to have a meeting with CBS to talk about
the issue they had disagreed about.

September 2 CBS

VP of Hard News and Special Events Lane Venardos, on behalf of CBS News,
invited Lin Huang (of CBS-IC), Ning Luo (of IFCSS), three Chinese student
representatives from three local universities, Ginny Gong (of OCA),
Kunglee Wang and Dawei Lee (executive director and general secretary of
the Committee of 100 respectively) to a luncheon to be held at the CBS
headquarters in New York on September 19. (The luncheon was rescheduled to
October 18 because of the unexpected American invasion of Haiti on
September 18, one day before the original date.)

October 12 USCCR
Chairperson Mary Frances Berry of the United States Commission on Civil
Rights wrote to CBS News President Eric Ober expressing concern over the
possible negative effects of the spies report and urging CBS to show
special sensitivity to racial and ethnic tensions.

October 18 LUNCHEON BETWEEN CBS AND CHINESE COMMUNITY

Representatives from CBS-IC, IFCSS, local universities, OCA, C/100, and
APABA (Asian Pacific American Bar Association) met CBS News President and
VP, their lawyer, Connie Chung, and several news production personnel at
the headquarters of CBS in New York to have a luncheon. Both parties
exchanged opinions extensively on all the important issues involved in the
spies report incident and there were moments of intense debate and
confrontation. President Eric Ober apologized to all the Chinese (American)
participants for the spies report in dispute at the very beginning of
the meeting. Upon the demand for reply about a public on-the-air apology
by CBS, President Eric Ober agreed to respond within a week at the latest.
After the luncheon representatives from the Chinese community were treated
with a guided tour of the CBS News facilities. The whole meeting took about
three hours.

October 19 C/100

Committee of 100 executive director Kunglee Wang sent a letter to Paul
Simon, United States Senator from Illinois, urging his to contact Mr. Ober
personally in support of the Chinese community's request for an apology.

October 20 CBS

CBS News President Eric Ober sent a letter to OCA National President Ginny
Gong informing her of CBS' decision to " set the record straight "11 on the
next day's edition of The CBS Evening News.

We are fully aware that the vast majority of Chinese, Chinese Americans,
and other Asian Americans are exactly what they seem to be: legitimate,
law-abiding students , visitors, immigrants and citizens, both long and
short-term. If our story did not convey that awareness, we fully apologize.

October 21 CBS

Coanchor Connie Chung broadcasted the clarification about the Chinese
spies report, the full transcript of which appeared at the beginning of
this chapter. Curiously, the closed caption text of the clarification
printed simultaneously at the bottom of the screen was a little
different, especially the last line, which read,

If we left an incorrect impression, we apologize.13

Obviously, the closed caption version of the clarification was prepared
beforehand and presumably should be more accurate than the broadcast. The
substitution of " regret it " for " apologize," which was not an
insignificant alteration, remains a mystery.

October 24 CHINESE (AMERICAN) COMMUNITY

The Organization of Chinese Americans, the Committee of 100, CBS Incident
Committee, and Independent Federation of Chinese Students and Scholars
issued a news release entitled " Chinese American Organizations Accept
CBS' Apology for Chinese Spies Story." The news release said that "Chinese
Amercian organizations today welcomed a rare, on-air clarification by CBS
concerning the CBS Evening News' May 19 segment on Chinese spies in the
United States."14 It declared as a conclusion that

This result shows that when the Chinese American community joins
together, we can be a potent force. We no longer will remain quiet when
Asian Americans are portrayed negatively. We no longer will be the
silent minority when negative stereotypes are used to perpetuate the
image of Asian Americans as forever foreign.15

Announcement of the Establishment of
The Committee of Chinese Students and Scholars Against HR2202
at UCLA

August 22, 1995

Dear CSSA members,

On June 21, 1995, Congressman Larry Smith (R-TX) introduced a bill
called HR1915, which was approved by the House Immigration Subcommittee
on July 19. Recently the bill was marked up as HR2202. Representative
Henry Hyde (R-IL), Chair of the House Judiciary Committee, has expressed
his intention to vote on the bill immediately after Congress returns
in early September.

If the bill passes, it will bring an end to most family-based immigration
for the Asian Pacific American community. It will aversely affect the
benefit of all our Chinese Students and Scholars and their families.
It will also reduce the quota of employment-based immigrants tremendously,
which will affect the Chinese student who are not covered by CSPA.

Here are some facts about the bill:

- Having Smaller quota, fewer categories and tougher requirements
HR1915 proposed to overhaul the entire immigration system:

* Reduces employment-based immigration to a maximum of 135,000 per year.

* Eliminates Labor Certification Exemption for Outstanding Professors
and Researchers.

* Eliminates National Interest Waiver Immigration.

* Eliminates Unskilled Worker Immigration Category.

* Establishes Tougher Experience Requirements for Professionals and
Skilled Workers. Professionals will be required to have five years.
Skilled workers will be required to show seven years of experience.

* Restricts Family-Based Immigration. U.S. citizens and permanent residents
will be unable to bring their adult sons and daughters to the U.S.
and will have more difficulty bringing in other family members.

- Connecting the quotas for family-sponsored immigration with employment-based
immigration

* If the family-sponsored immigration does not have sufficient quota
allocated in a particular year, then certain employment-based
immigration quota will be taken away to meet the need of the
family-sponsored immigration, up to HALF in the investor and in
the professional and skilled worker categories.

- Requiring employers to pay 10% more for non-immigrant workers

* under HR2202 "Bryant amendment on laid-off protection for American
workers", unless a position is NEWLY CREATED, or the previous
employee retired, the employer MUST pay 10% more to hire you,
a non-immigrant worker, as long as you are on the waiting list for
an immigrant visa.

Why HR1915 and HR2202 at this time? Right now the general public sentiment
is AGAINST immigration. Congressmen know that and they're trading YOUR
CHANCE to immigrate for their votes.

What can we do? As non-immigrant students and scholars, we had led to
the successful passage of CSPA; we had extracted an apology on the air
from CBS. With more and more of us get involved in the effort,
we can stop the bill, or make it better. WE CAN MAKE A DIFFERENCE.

What should we do? It is time we stand again, join hands to make our concerns
heard. If we don't care, who else will? If we don't try, who else will?

All the potential candidates for the next year's CSSA-UCLA committee agreed
to take the lead on our efforts against HR2202. Hereby we establish a
committee to coordinate all the activities, including holding town-hall meetings
, contacting various offices and groups on campus, communicating with other
similar groups across the nation, and most importantly writing/meeting
congressmen in California.
